II. EXECUTIVE PROGRAMME OF CULTURAL AND EDUCATIONAL COOPERATION BETWEEN THE ITALIAN REPUBLIC AND THE SOCIALIST REPUBLIC OF VIETNAM FOR THE YEARS 2004 - 2007
The Joint Commission was held on November 9th 2004, in Hanoi, in accordance with Art.4 of the Cultural Agreement signed on May 18th 1990, in Hanoi. The two parties wishing to further develop their co-operation in the field of culture and to contribute towards strengthening the bonds of sincere friendship between both countries and peoples, have agreed upon the following cultural and educational co-operation Programme for the years 2004 - 2007.
1. PROMOTION OF LANGUAGE AND CULTURE
1.1. The two parties shall endeavor to promote the spreading of their respective languages and cultures in each own country.
To that end, the Italian party will examine the possibility of providing academic and school institutions with textbooks, as well as audio-visual aids and other educational materials, for the teaching of the Italian language and for training and refresher courses for teachers and assistants. Requests shall be submitted through diplomatic channels.
1.2. The Vietnamese party stresses its wish that an Italian Cultural Institute be soon opened in Hanoi to promote and co-ordinate activities in the field of the Italian language and culture promotion.
1.3. The two parties take note with satisfaction of the academic activity of the Italian Lecturer at the Hanoi University of Foreign Studies sent by the Italian Government.
1.4. The Italian party will examine the possibility to provide its financial support to the Hanoi University of Foreign Studies and to the University of Social Sciences and Humanities of Ho Chi Minh City, for setting up and maintaining courses of Italian language and culture.
The two parties are pleased to acknowledge that a Department of Italian has been set up at the Hanoi University of Foreign Studies of Hanoi in the academic year 2002 - 2003. They also express their wish that a department of Italian Language be promptly set up at the University of Social Sciences and Humanities of Ho Chi Minh City.
1.5. The two parties will promote the establishment of an experimental Italian language course to be taught in a Vietnamese secondary school institution, to be chosen as soon as possible. The Italian party will examine the possibility to provide assistance for curricula and syllabuses drafting, teaching materials and expenses for the teacher(s) of the Italian language.
1.6. The "Dante Alighieri" Society, which deals with the diffusion of Italian language and culture, operates in Vietnam through the Committee in Hanoi and foresees, for the years 2003/2006, the granting of at least 4 scholarships to attend Italian language courses in Italy. The amount of each scholarships is Euro 1550,00.
1. 7. The Italian party will examine the possibility to provide its financial support for training and refresher courses for teachers of Italian language organized by Universities in Vietnam.
2. CO-OPERATION IN THE FIELD OF EDUCATION
2.1. The two parties will exchange books, publications and audiovisuals with the aim of enhancing the knowledge of their respective cultures, education system and methods of their respective countries.
2.2. The parties agree that all initiatives in the field of school education shall be specified through diplomatic channels by the relevant Ministries of the two countries.
2.3. The two parties will encourage and support a mưulti-faceted co-operation between universities and higher education institutions of their respective countries, also with reference to the agreements indicated in Annex I, through: a) the signature of agreements and conventions particularly in the fields of education,
Far East studies, Oriental studies, Italian studies, Vietnamese studies, lexicography, translation and economic science; b) the implementation of activities in the field of the conservation and promotion of archaeological heritage; c) the exchange of professors, scientists and university lecturers, especially in the above-mentioned topics.
The two parties will inform each other on existing inter-university agreements and of those to be negotiated and finalized in the future.
2.4. Both parties shall yearly exchange visits up to 2 university teachers and/or researchers, for a period not exceeding 10 days, giving priority to the visits aimed at setting up university co-operations.
3. SCHOLARSHIPS
3.1. The Italian party shall award 60 man/months scholarships yearly to Vietnamese citizens in the fields of science, technology, Italian studies and archaeology.
3.2. The Vietnamese party shall award 30 man/months scholarships yearly to Italian citizens for Vietnamese language courses, vocational training courses and researches.
3.3. Each party may change the number of man/months scholarships offered for the following academic years, in accordance with the funds available each financial year. All changes shall be notified through diplomatic channels.
4. ART AND CULTURE
Exhibitions and Cultural Events
4.1. The two parties will favour the exchange exhibitions intended to better illustrate the art and cultural heritage of the two countries.
Details, financial conditions included, shall be defined through diplomatic channels (see Annex II c).
4.2. The two parties shall exchange events in the fields of music, ballet and drama and shall improve the exchange of information on festivals, celebrations and major cultural events organised in their respective countries. In particular, the respective Diplomatic Missions shall envisage specific actions to disseminate the information among Regional and Provincial Authorities, Associations and business entities in the view of ensuring additional funds for the organisations of the above-said events.
The details, financial conditions included, shall be defined through diplomatic channels on a case by case basis.
4.3. The two parties are glad to acknowledge that the "Valentino Bucchi" Foundation is willing to realise joint initiatives for the contemporary artistic and cultural creations. In particular the Foundation, through the Embassy of
Vietnam in Rome, intends to invite musicians and experts nominated by the sending country to become members of the international juries of the "Premio Valentino Bucchi di Roma Internazionale", a festival of musical performance and composition competitions for 20th and 2Pt century music, (in 2004 is the 27th edition), and other activities (conferences, seminars, festivals and exhibitions). The Foundation shall bear only and exclusively board and accommodation costs; travelling costs will be paid by the sending party or by the institutional entity delegated by it. The Foundation is available to any other possible forms and occasions of exchange in the field of art and culture.
4.4. The two parties take note that the Italian association "Centro di studi vietnamiti ONLUS" of Turin (CSV), in co-operation with other associations, universities and academies in Turin, intends to further expand its activities in order to promote the Vietnamese culture in Italy in particular in the fields of art, music, libraries, archives, publishing and translation, CD as well as education and training tourism and handcraft.
Cinema
4.5. Both parties shall favour co-operation between their organisations, public and private, through common projects of
promotion and co-production of movies; the exchange of artists; the participation in festivals, celebrations, workshop and international major cultural events, in order to increase the value of the cinema of both countries. (see Annex II e).
4.6. The Italian party will favour the participation of Italian films in the most
Important Vietnam film festival, particularly in the "Cinema International Festival - Hanoi".
Archives
4.7. The two parties shall encourage cooperation between their respective Archives Administrations, through the exchange of scientific publications, microfilms, copies of documents and regulations, in compliance with their current national legislation and on a reciprocal basis.
During the period of validity of this Programme, the two parties shall exchange the visit of 2 archivists for each party for a total period not exceeding 14 days, provided that detailed working programme is previously agreed upon.
4.8. The General Directorate for Archives of the Italian Ministry for Cultural Heritage and Cultural Activities expresses its willingness to hold training internship courses on preservation, restoration and related new technologies, to be organized by Italian archive Institutes, in particular the "Centro did Fotoriproduzione, Legatoria e Restauro deli Archive did Stator" (Dye Transfer, Bookbinding and Restoration Center of the State Archives) in Rome.
4.9. The two parties shall favor the cooperation between their Foreign Ministries Historical Archives on the basis of
Reciprocity and in accordance with legislation in force in both countries through exchange of information and publications.
5. LIBRARIES AND PUBLISHING
5.1. The two parties will promote the exchange of books, publications and periodicals between Libraries and Cultural Institutions of the two countries.
5.2. The two parties shall encourage, in accordance with their own legislation, the exchange of copies and microfilms of the books kept in State Libraries.
5.3. During the period of validity of this Programme the two parties shall exchange, on a reciprocity basis, 1 librarian for each party for study visits for a total period not exceeding 8 days.
5.4. The Italian party expresses its willingness, through the Ministry for Cultural Heritage and Cultural Activities, General Directorate for Books Heritage and Cultural Institutions", to send books of any field and subject to universities and cultural institutions requesting them through diplomatic channels.
5.5. During the validity of this Programme, the Ministry for Cultural Heritage and Cultural Activities, General Directorate for Books Heritage and Cultural Institutions expresses its willingness, upon request, to provide experts on conservation, restoration, classification, computer technology, library building and promotion of library assets. Details shall be defined through diplomatic channels.
Moreover, the Italian Ministry for Cultural Heritage and Cultural Activities, General Directorate for Books Heritage and Cultural Institutions expresses its willingness, during the period of validity of this Programme, to send a publishing exhibition and/or to show the preservation and enhancement activities in the field of book heritage.
5.6. The Italian party informs about the following awards:
- Financial awards and grants offered by the Ministry of Foreign Affairs, Directorate General for Cultural Promotion and Co-operation, to Italian and/or foreign publishing houses and translators who submit proposals with the purpose of disseminating Italian books, for the translation of literary and scientific works as well as the translation, subtitling and dubbing of short- and full-length motion pictures and television series for the media.
The Vietnamese party will circulate the above information in Vietnam, specifying that applications shall be sent to the Italian Embassy in Hanoi, in order to be later submitted to the National Commission for the Promotion of Italian Culture at the Italian Ministry of Foreign Affairs.
- The Italian Ministry for Cultural Heritage and Cultural Activities awards the Italian National Prize For Translations, under Italian Republic President patronage, to foreign translators and editors. Moreover the Italian "Center for Translators and Translations" is available to establish contacts with analogous Vietnamese Institutions.
- Prizes to translators of Italian books in foreign languages are also awarded by the Department of Information and Publishing at the Office of the Italian Prime Minister. Applications should be submitted through diplomatic channels.
6. PROTECTION OF CULTURAL HERITAGE
6.1. The parties commit themselves to collaborate in the fight against illegal trafficking of cultural assets, by precautionary, repression and remedial actions according to their respective national legislation and taking into consideration the principles of international UNESCO Convention of 1970 on prevention and prohibition of import, export or transfer of cultural assets property and of UNIDROIT Convention on Stolen or Illegally Exported Cultural Assets (1995).
Both parties shall also co-operate to facilitate the identification and the return to their lawful owners of works of art and cultural assets that have illegally been taken to their territory.
6.2. The Italian Party, Ministry for Cultural Heritage and Cultural Activities, General Directorate for Architectural and Environmental Heritage, is willing to cooperate by sending experts supplying a scientific support to the protection of architecture heritage. Expenses shall be borne by the requesting party on a case-by-case basis.
6.3. The two parties shall encourage cultural exchanges and the implementation of joint research projects in the fields of archaeology, archaeometry, pale biology as well as joint activities in the study and enhancement of archaeological and monumental places also through the competence and experience of the Italian Institute for Africa and the Orient (Is.IAO), the "Centro di Studi Vietnamiti" of the University of Turin and the "Istituto Orientale di Napoli".
In particular IsIAO is available to examine the possibility of participating in the organization of an anthological exhibition on arts, archaeology and ethnology of Vietnam in co-operation with the relevant Vietnamese Authorities, other Italian institutions and in case with European partners.
6.4. The two parties take note with satisfaction of the implementation of the project "Safeguarding of My Son World Cultural Heritage Site, financed by the Italian Government through UNESCO. In this framework a scientific workshop on the Conservation of My Son Sanctuary was successfully organized in Hoi An in March 2003.
6.5. The two parties shall promote and encourage archaeological or anthropological studies, research and missions by the other party in its own territory.
6.6. The Italian Ministry of Cultural Heritage and Cultural Activities, General Department for Archaeological Heritage expressed the possibility to send, if requested, to Vietnam an expert on oriental archaeology. Expenses shall be borne by the requesting party on a case by case basis.
6.7. The Vietnamese party asks the Italian party to organize vocational and training courses in Italy for Vietnamese experts in the field of archaeology.
The Italian party may consider to organize, if requested, on a case by case basis, vocational and training courses in Italy for Vietnamese experts.
Expenses shall be borne by the requesting party.
7. RADIO AND TV COOPERATION
7.1. The two parties shall encourage exchanges in radio and television fields in order to promote and facilitate, in both countries, knowledge of events between the relevant institutions in various areas. In particular they shall:
- allow the link-up of television programme via satellite;
- organize radio-tv programme festivals;
- provide television broadcasting of Italian Language training courses.
8. SPORT AND YOUTH
8.1. Both parties will encourage the development of different sport activities through the exchange of experiences and information between their sports associations and between Olympics Committees.
8.2. Both parties will favor the devil orpiment of cooperation in the field of youth exchanges and the carrying out of joint initiatives promoted by state and private bodies and by youth associations in both countries.
9. TOURISM
9.1. The parties will encourage the development of tourism.
To this purpose, each party might request the constitution of an ad hoc working group which could convene alternatively in the two countries, in order to promote in the mưutual interest the tourist initiatives, including the marketing and investment sectors.
10. HUMAN RIGHTS
10.1. The two parties shall encourage activities in the field of education and culture which are directed towards ensuring the full protection of internationally recognized human rights. In particular they shall intensify the struggle against racism, intolerance and xenophobia. In this respect, the relevant Italian institution is the Inter-ministerial Committee for Human Rights of the Ministry of Foreign Affairs.
10.2. Both parties will encourage cultural activities in order to favor equal opportunities for men and women and the enhancement of the role of women and their creativity in cultural field.
In this regard they shall promote meetings, conferences and seminars as well as relationships between competent organism.
The Department for Equal Opportunity of the Presidency of the Council of Ministers expresses its readiness to co-operate with relevant bodies of the Vietnamese party.
11. COPYRIGHT AND RELATED RIGHTS
11.1. The two parties hope to develop the bilateral co-operation in copyrights and related rights protection, between the relevant government administrations. For the Italian party the relevant administrations is Ministry of Cultural Heritage and Cultural Activities, Department XI, Copyright and Surveillance SIAE.
12. FINAL PROVISIONS
12.1. This Programme does not rule out the possibilities of agreeing on other initiatives not indicated herein, through diplomatic channels, provided that they are previously authorized by the two parties. The financial provisions regulating these initiatives will be agreed upon, on a case by case basis, through arrangements between both countries' concerned bodies.
12.2. Both parties agree that all the initiatives mentioned in this Programme would be carried out within the limits of the financial resources yearly established by their budgets.
12.3. Both parties agree that all activities of this Programme shall be compatible to the two countries' legislation.
12.4. The Ministry of Education and Training and The Ministry of Culture and Information shall be principal representative of the Government of the Socialist Republic of Vietnam in facilitating to implement this Programme.
The relevant administrative bodies shall represent the Government of the Republic of Italy in facilitating the implementation of this Programme.
12.5. The next meeting of the Joint Commission shall be defined on a date to be agreed upon through diplomatic channels.
This Program will remain effective until a new one is subsequently signed, but in no case later than 2008.
12.6. Annexes I and II are considered to be an integral part of this Programme.

CÁC ĐIỀU KHOẢN CHUNG VÀ CÁC ĐIỀU KHOẢN TÀI CHÍNH
II a) Trao đổi công tác
Các điều khoản sau được áp dụng cho các chuyến trao đổi công tác như đã được đề cập đến trong các đoạn 2.4, 4.7 và 5.3 của Chương trình này.
Phía cử phải đề nghị phía nhận về các chuyến trao đổi công tác thông qua các kênh ngoại giao ít nhất 3 tháng trước đó.
Bên cử sẽ cung cấp những thông tin sau đây:
1. Tên đầy đủ và quốc tịch của người được cử đi (các giảng viên/nghiên cứu viên thăm Việt Nam phải mang quốc tịch Italia và ngược lại các giảng viên/ nghiên cứu viên thăm Italia phải có quốc tịch Việt Nam), sơ yếu lý lịch và ngoại ngữ mà họ có thể sử dụng.
2. Chương trình công tác dự kiến, nêu rõ tên của giáo sư và khoa sẽ tiếp đón.
3. Thời gian và độ dài dự kiến của chuyến thăm.
Phía nhận phải có khẳng định cuối cùng về việc chấp nhận đón đoàn ít nhất một tháng trước ngày đoàn đến theo kế hoạch.
Phía nhận phải trả mọi chi phí đi lại của đoàn đến các địa điểm trên lãnh thổ nước đó như kế hoạch công tác đề ra.
Phía cử phải chịu mọi chi phí đi lại từ thủ đô nước mình sang thủ đô nước bạn và ngược lại.
Phía Italia cấp cho khách Việt Nam khoản trợ cấp trọn gói là 93 euro (chín mươi ba euro) một ngày. Phía Việt Nam cấp cho khách Italia khoản trợ cấp trọn gói từ VND 800.000 (tám trăm ngàn Việt Nam đồng) đến VND 1.000.000 (một triệu Việt Nam đồng) một ngày.
II b) Học bổng
Việc tuyển chọn ứng cử viên cho các suất học bổng được thực hiện hàng năm tại mỗi nước thông qua một ủy bản chung gồm một đại diện của Đại sứ quán nước cấp học bổng làm chủ tịch. Danh sách các ứng cử viên được lựa chọn phải gồm cả các ứng cử viên dự khuyết và trình lên Đại sứ quán nước cấp học bổng trong thời hạn dự kiến trước. Các ứng cử viên không có tên trong danh sách trên không được chấp nhận.
Mỗi bên phải thông báo cho nhau trong vòng 2 tháng trước khi khai giảng năm học mới việc các ứng cử viên và kế hoạch học tập của họ có được chấp nhận hay không và phải thông báo rõ tên trường họ sẽ được nhận vào học.
Các ứng cử viên không được quá 40 tuổi.
Người được cấp học bổng không được rời nước mình cho đến khi nhận dược bản thông báo cụ thể từ Đại sứ quán nước cấp học bổng về ngày khởi hành sớm nhất.
Phía ltalia cấp cho các sinh viên Việt Nam được cấp học bổng:
1. Tiền phụ cấp trọn gói hàng tháng ít nhất là 619.75 euro.
2. Bảo hiểm y tế và tai nạn, không bao gồm viện phí cho các bệnh đã có tiền sử từ trước và chi phí làm răng giả.
3. Vé máy bay 2 chiều hạng rẻ nhất Hà Nội/Rôm/Hà Nội.
Phía Việt Nam cấp cho các sinh viên Italia:
1. Học bổng cho sinh viên đại học:
750.000 đồng/tháng, học bổng dành cho nghiên cứu sinh và thực tập sinh: 820.000 đồng/tháng.
2. Chỗ ở ký túc xá trong thời gian của khóa học (2 người/1 phòng).
3. Bảo hiểm y tế.
II c) Triển lãm nghệ thuật
Liên quan đến những vấn đề quy định tại điểm 4.1 của Chương trình này, trao đổi các triển lãm phải được tiến hành theo các điều khoản tài chính như sau:
a) Phía gửi triển lãm chịu các chi phí:
- Chi phí bảo hiềm cho từng chi tiết.
- Chi phí vận chuyển đến địa điểm triển lãm đầu tiên và từ địa điểm triển lãm cuối cùng về nước.
- Chi phí đi lại cho chuyên gia đi theo triển lãm đến địa điểm triển lãm đầu tiên và chi phí về từ địa điểm triển lãm cuối cùng (trong trường hợp cần nhiều chuyên gia hơn, số lượng chuyên gia và độ dài chuyến công tác phải được thống nhất theo từng trường hợp cụ thể thông qua các kênh ngoại giao).
b) Phía nhận triển lãm phải chịu các chi phí sau đây:
Chi phí vận chuyển các hiện vật trưng bày trong lãnh thổ nước mình.
Các chi phí quảng cáo và tổ chức triển lãm.
Chi phí phát hành catalogue, trừ khi có các thỏa thuận khác.
Chi phí đi lại, ăn, ở cho các chuyên gia đi theo triển lãm.
Chi phí hải quan, gồm cả chuyển tải.
Trong trường hợp hư hỏng hiện vật trưng bày, nước nhận phải gửi tất cả tư liệu liên quan đến việc hư hỏng này cho nước gửi. Chi phí cho việc đánh giá những hư hỏng này sẽ do nước nhận chi trả. Trong bất ký trường hợp nào cũng không được tiến hành tu sửa hiện vật nếu chưa có sự cho phép chính thức của nước gửi.
II d) Các buổi biểu diễn âm nhạc, chính kịch, vũ thuật, thời trang
Việc tổ chức các buổi biểu diễn âm nhạc, chính kịch, vũ thuật, thời trang phải được hai bên thỏa thuận, theo từng trường hợp, tùy theo khả năng tài chính và các điều kiện thuận lợi hơn cho cả hai bên.
II f) Điện ảnh
Hai bên thỏa thuận với nhau chi phí tổ chức chiếu phim và festival phim theo từng trường hợp cụ thể, phù hợp với khả năng tài chính và điều kiện tài chính thuận lợi hơn cho cả hai bên.
Tất cả các sáng kiến được Vụ phim ảnh Bộ di sản và các hoạt động văn hóa trợ cấp về tài chính phải dựa theo ý kiến ủng hộ của ủy ban cố vấn về Điện ảnh.
II g) Các điều khoản khác
Trong khuôn khổ luật pháp hai nước, hai bên dành chế độ đối xử ưu đãi nhất về nhập cảnh, lưu trú, xuất cảnh và tạm nhập khẩu các hạng mục cần thiết cho mục đích công tác hoặc để phục vụ các hoạt động của các cá nhân và tổ chức đến công tác tại nước mình hoặc có các hoạt động trong khuôn khổ Hiệp định Văn hóa./.
